The due process argument is interesting, as is this. It's not just a matter of taking Trump off the ballot. Even if voters write his name in, those votes aren't counted. So it's also disenfranchisement for voters. I frequently hear the argument of term limits and age limits on representatives and senators as being unconstitutional because you can't limit who people can vote for. Well, here we are. You're trying to tell people they can't vote for Trump because *Colorado* says he engaged in insurrection, whatever that is. Finally, the precedent this sets is nasty. Do they seriously think that this won't be abused in the future to keep "their guy" off the ballot? These people are so shortsighted it makes my head hurt.

We often warn that Republicans could also employ this type of "lawfare" against Democrats once bad precedents like this have been set. That warning assumes a more or less equal split between Democrats and Republicans in the legal community. I doubt that's the case. Republicans would have a difficult time using this tactic and are less likely to try given their greater respect for constitutional constraints on government power.

It's not necessarily Ds vs Rs. It's the precedent given to the establishment. Now they can knock any populist candidate out of the running if they can find that they "insurrected" some how. Look for Ds to use it on populist candidates in their own party and Rs to use it on populists candidates among them And Rs do occasionally do the tit-for-tat. The Ds lowered the threshold for lower court judges and the Rs did the same for SCOTUS justices. I can also see Rs going after an Ilhan Omar or a Rashida Tailib, just to score points with their base.

Good point, particularly as it applies to the SCOTUS tit for tat. Republican politicians were able to accomplish that directly, however, without co-opting the legal community. They simply had to ignore the filibuster using the actions of Harry Reid as justification. You're also correct that it may be more accurately characterized as establishment (i.e., most of the legal community) vs. the populists.

I was born and raised in west by-God Texas but I’ve been in Colorado for 23 years now, 22 of them in a very rural setting. Urban Colorado is not Colorado anymore, it’s contemporary California. Boulder-Denver is now a Mecca for the Fuchsia-shirted Elites.

Most of the intelligent people have moved into the countryside--or Wyoming--and only the Intellectuals are left, working studiously to outdo their neighbors’ Smart Homes and EV’s and trans-kids.

It’s much worse than that, my friend. “Insurrection” is at least a defined term with a corresponding criminal statute. “or given aid or comfort to the enemies thereof,” the other clause in that sentence, could mean literally anything. Is Trump an enemy of the United States? Based on this ruling, they sure think so. Did you donate to Trump? Did you vote for Trump? Were you a congressman who supported him? Then you have given aid or comfort to enemies of the United States and are disqualified from holding office. No due process required.

If this decision stands, we are on the slipperiest of slopes to one party rule.

The 1/6 Report is its own thing, worth its own piece. The authors were not given access to any law enforcement files. Meaning, they were relying on open source information and volunteering witnesses (many thought that cooperating with the Committee would get them good will in the separate criminal proceeding). It is, the the account of the authors, a narrative and not an investigation.
