On one hand, obviously a nice win. I'm worried it's too narrow and easy to avoid by just having different government employees ask for the censorship -- or "non-government" employees like the ones at Stanford.
Agreed, however, if someone else tried to censor, this case would be immediately brought up on any future case or appeal's. At a minimum, it's precedent now. Not sure, but didn't it mention "proxies" as included, and forbidden?
Not a win,,,The Demoncrats don't care about laws now...Another American College student murdered near her dorm by illiegal and Pritzger the Governor blamed it on the federal laws saying as usual,,,We need immigration Reform....A-----E.....Trump shut the border in 3 months and now we don't have a problem,,,But if you want to change the law,,go back to the Original Immigration law..Which was great for America From 1800 to 1965....Has anyone READ the two laws? That's a fair point. When (it's not looking like IF at this point) the dems retake power, they won't be observing any rules or even decorum. ALL the troublemakers will be rounded up and imprisoned. Just like the J6 group.
It's gonna be brutal. Too bad DJT is just exacerbating the situation with his antics.

There's this: author - "consent decree that will prevent the federal government from throttling dissent through proxies. You can read it here. The heart of it."

Interestingly, I think I recognized the name of the one of the plaintiff doctors in this case. He was one of the emergency room physicians working in Imperial County who, with another emergency room physician, made a 3-hour video ---- it was early in the Covid Fake Hysteria era ---- that sought to ease many of the fears, through factual information and their own hands-on experience, that had been raised about the "pandemic." At first it went "viral," but then was quickly scrubbed from the internet.

You are right that it — in itself — is too narrow. It’s a consent decree, not a judicial decree, and it specifically names the defendant agencies (CDC, CISA, etc) plus their employees and agents (i.e., those who represent these agencies in some capacity). It does not apply to those who were not a party to the lawsuit (the rest of the government), BUT… it certainly shows which way the wind is blowing…at least for now.
There is no disinformation, malinformation, or misinformation. There is only information an adult chooses to accept or to reject. I choose to reject those three words, and the authority of anyone attempting to invoke them.
I'll buy that! Would only add that in addition to rejecting authority of one who would invoke those terms, that individual should likewise be subjected to a firm kick in the ass from a pointy-toed cowboy boot. Very firm.
Like the notion of “hate crimes.” Crimes are crimes; if I assault, maim, or kill somebody because of their race/creed/sexual preference/etc., I’ve committed a crime and they’re just as affected as if I did it for the heck of it. “Hate crimes” and “hate speech” permit certain groups and the government to assign special status to those groups. Not equality under the law.
Commies invented Hate crimes,,we never had that,,crimes were based on two things action and mens rea...Now its what do they people involved look like,,Huge guess,,,in what decade was Hate crime invented?? The Answer tells you everything.
Yes, it's automatically assumed that in a crime that involves whites and blacks, it's a hate crime when the victim is black, but never the other way around.
Words and language can be used to inform or manipulate. Propaganda is a highly sophisticated art and science of manipulation, and we are the prey. It’s always a mistake to assume that someone is not trying to manipulate us for their own purposes, or that we are so smart we are immune. This is the 21st century equivalent of eternal vigilance.
The science of general semantics is very helpful in understanding and protecting oneself. Developed by a fellow named Alfred Korzybski and refined by S.I. Hiyakawa who later went on to become dean of UC Berkeley during the sixties. He had his hands full as the adult on a campus of of spoiled toddlers.
All communication intends to manipulate, unless it's just the kind that's the equivalent of "Uh huh, mhm, I hear you" or "Yeah, I'm still here." And even that intends the other party to conclude that things are well, nothing has changed. (Which can be a lie/manipulation.)
Unfortunately the study of classical rhetoric fell out of fashion many years ago, replaced with the concept of technologies through which strangers deliver TrUtH.
I am ever astonished by people who speak of the "good old days" when newsmen represented only THE FACTS, and there was no manipulation involved.
The whole point of communicating is to cause some sort of change in others' perceptions or behaviors. There are differences of scale when some people get hold of powerful amplification technologies representing particular interests. But "to inform" is also to manipulate.
PS--Hayakawa was never at Berkeley.
manipulation(n.)
by 1730, a method of digging ore, from French manipulation, from manipule "handful" (a pharmacists' measure), from Latin manipulus "handful, sheaf, bundle," from manus "hand" (from PIE root *man- (2) "hand") + root of plere "to fill" (from PIE root *pele- (1) "to fill").
Sense of "skillful handling of objects" is attested by 1826; extended 1828 to "handling or managing of persons," especially to one's own advantage.
All communication is about persuasion, even manipulation in the strictest sense.
Even with "free ranging"/open discussion, where people just put ideas out there (as here in Salon Bray), at some level the intent is that someone else will read your words/thoughts and have their own thinking impacted. OR that they will give feedback that impacts your own thinking. Either way it's an intensely creative process.
Which is where I get cranky at the Punishers.
If my words don't persuade you of Whatever, or yours don't persuade me, or I need to think more, or dig more...we can shrug or shake hands in the moment. I don't want to have you hauled before a court, or silenced, or beaten by legal or street thugs. We interact in a creative energy, give and take, different views. If you're a yammering goomba or blurt-bot maybe I'll dismiss you, or make fun of your brain. But the idea of turning you over to some tribunal for badthink isn't even in the room.
All creative possibility gets lost where nasty punitive forced opinionating has the upper hand. In my experience that sort takes that road because their ideas and opinions can't hold their own in creative discursive settings. That doesn't always make their ideas bad. But the admixture of political, social, or economic power with impatience to inflict ideas and power to punish dissent never goes well for a civilization. It's why my ancestors put the First Amendment first.

A bank gets robbed by a criminal gang who gets caught. Instead of sending the gang to jail, the judge issues a “landmark decision” stating that banks shouldn’t be robbed and people who would do so are hereby prohibited.
A legal version of “mistakes were made.” The passive voice that intentionally hides the guilty and informs no one.
In every class I took in college, there was always a small group of girls who would asked the professor the same question, "Is this gonna be on the exam?". Well, they`re now in charge of everything.
In my classes it was men doing that, and there weren't many girls in those classes.
Optimization of effort is a human thing, not a gendered one, and that expectation is there only because of the pedagogical weakness of untold numbers of whizz-poor teachers. A teacher's job is to make students want to learn, and then assemble and show what they know. That question is the top indicator that the teacher long ago lost the students...and doesn't care.
The perceived storehouse of useless knowledge is vast and deep in many female minds, while the amplification of feelings has at the same time risen to breathtaking levels of hysteria. Oh, and the punishment for doing it anyway is... if you get caught, you have to stop.
Also, I love this: "...shall take no actions, formal or informal, directly or indirectly—except as authorized by the Constitution, statute, judicial order, or regulation—to..."

As Chief Justice Justice Charles Evans said: "We are under a Constitution, but the Constitution is what the judges say it is." If a constitution and a statute say different things, which controls? As a state senator in my state once asserted (when talking about gun control laws), if a constitution and a statute conflict, then the statute must be constitutional, because we have it. That view explains how we can have hundreds of laws abridging freedom of speech, and infringing on the right to keep and bear arms, even though the Constitution prohibits them.
And so on. The system is fundamentally broken, and this ruling does nothing to address that. Yes, the ruling is good news, but good news on the order of "Sure, the space station will be out of oxygen soon, but we found some chocolate we didn't know about in one of the food cases." The fundamental problem isn't that those agencies were abusing power, but that they shouldn't exist in the first place. As Marvin Minsky might put it: The only parts of a government that can be trusted are the ones that aren't there.

Another good win for speech was the Afroman case he just won against the cops that abused their power to search his house that he had surveillance of as they ransacked it. He mocked them and made songs to earn funds to pay for the repairs from the damage they caused after they found nothing he was being accused of. Ironic that the Left is always mad at the Left and are too stupid to realize they are the Nazis they warned us about in the social studies classes i took in the 80's. Cant wait to see what happens tomorrow- lol
There is at least one Supreme Court Justice who is going to need someone to explain this to her.
And slowly I might add.
Plus use words with no more than 3 syllables.
She uses a doll to show where she was "touched".
😂😂😂
And never say the word women as they have no idea what that is
🤔 How do you know it's a woman?
Thought there were 3 with no concept.
The third one is really "special".
Her....?
What are you a biologist?! 😂🤣😂
Hers
And midway through that explanation the explainer will be able to smell the burning wires shorting out in her tiny brain.
On one hand, obviously a nice win. I'm worried it's too narrow and easy to avoid by just having different government employees ask for the censorship -- or "non-government" employees like the ones at Stanford.

What is it in me that hears those words and immediately thinks that the speaker is too disingenuous to simply say "lies."
Always mindful of the magnificent performance by Burl Ives as Big Daddy in Cat on a Hot Tin Roof. "Mendacity! Lies and mendacity!"
This case was/is hugely important.
The covid censorship regime was completely unacceptable to any thinking person interested in actual freedom.
But we should be under zero illusions that the government (either party) will stop trying to control our speech and viewpoints.
Propaganda is the main pursuit of western governments because it is effective.

Glad for this ruling. As soon as I hear the label "misinformation" or "disinformation", I start to think the opposite. Dems conditioned me to do this.

Uh, I can't stand the idea of a lunatic of any gender or age thinking they have a right to infringe on anyone's right to speak, write or think.
I can tell you were never married.
Actually, not exactly a laughing matter. Sadly.
I never could get over how much she looked like the Kids in the Hall character, Nina of Joymakers (played by Mark McKinney).

Just read that after losing her defamation lawsuit again on appeal, she had been begging for gofundme donations to pay her legal bills on her substack.

After all, the courts are just more government.
Amen to that. No matter ones' belief system, the Ten Commandments really ought to do it, and yet here we are.
Remember, there ae people who are offended that the ten commandments appear on government buildings.
I am less than thrilled. Nobody is swinging on account of MASSIVE civil rights violations.
"Civil rights" is a rabid concept that needs the Old Yeller treatment.
Unquestionably good news. As a (retired) lawyer, though, I see a lot of wiggle room and loopholes in the language above.
Eternal vigilance and all that, my friends.

That was a long time coming. So long we still have people who say it never happened.
Needing to litigate this matter is a sign of deep government corruption.
Agreed
It’s only good if obeyed. They have repeatedly proven they’re willing to drive right through all kinds of laws and court orders.
